Blue Desert Software LLC (“BDS”) is committed to protecting and respecting your privacy.  This Privacy Policy (“Policy”) explains our practices regarding the collection, use and disclosure of information that we receive from you when you utilize our website at www.agendatrac.com, AgendaTrac (“Service”).  This Policy does not apply to any third-party websites, services, or applications, even if they are accessible through our Service.  Any information that we collect is subject to the Policy in effect at the time that the information is collected.  If you do not agree to with the Policy, do not use the Service.

  1. INFORMATION WE MAY COLLECT FROM YOU.  The goal of BDS in collecting information is to provide and improve our Service, and to administer your use of Service (including your Account, if you are the Account Owner).

Account Information - To create a Service account the Subscriber is required to provide a first and last name, company name, email address, and a password.  There are optional data elements, or profile information that can be entered by each user under the Service in the Account Preferences section.  Any profile information that is added to the Service can be visible to other individuals associated with the Subscribers team or company.

Billing Information - If the Subscriber purchases a subscription to use the Service beyond the initial free trial period, third party payment processors will collect and store the Subscribers credit card and billing address.

IP Address and Cookies - BDS may collect information about your computer, including the IP address, operating system and browser type, for system administration and customer support.

The Service utilizes cookies.  A cookie is a small file of alphanumeric content that is put on the computer if you agree.  These cookies are unique to your Service account or your browser and are used to maintain consistent information about your use of the Service.  You can manage your cookie settings from within your browser but if you disable all cookies you may not be able to use the Service.

Service Use - The Service automatically records information about the activity of individuals that are using the Service, this includes both Account Owners and non-Account Owners.  The information that is recorded can be the date and time that a user logged into the system, failed login attempts, password changes, pages that were accessed, and links that were accessed.  This information does not contain user content and is not routinely deleted.

User Supplied Content - The Service can be used in a collaborative way that permits users to share information.  The information added to the Service by the creation of meetings, or the uploading or attachment of documents to meetings, and any personal information added to meetings, is described in our Terms of Use.  This Policy does not apply to user supplied content that was entered in the function of utilizing the Service.

  1. HOW WE STORE YOUR PERSONAL DATA.  BDS takes reasonable measures to ensure that all personal data is kept secure for the duration of your use of the Service.

The transmission of information via the Internet is not completely secure but BDS uses all necessary means to keep it secure.  When information is entered into the Service, BDS encrypts the data elements, and then encrypts the transmission of that data using secure socket layer technology (SSL).  Although all efforts are taken to protect the personal data, we cannot guarantee the security of data transmitted to the Service, and any transmission remains at your own risk.  Upon receipt of data, we use strict procedures, security, and encryption features in order to prevent unauthorized access.

  1. DISCLOSURE OF INFORMATION.  With the exception to the BDS Terms of Use and this Policy, BDS does not disclose any personal information to any third parties without the authorization of the Subscriber.

BDS does not sell any personal information to third parties or allow any third party to use the information for sales and marketing purposes.  BDS uses third party payment processors to manage direct billing of the Subscriber.  These payment processors are not allowed to store, retain, or use any information provided except for the purpose of payment processing.

BDS may share information with third party vendors, consultants and other service providers who are working on behalf of BDS and require access to the information to complete work, such as billing, customer support, or system programming.  BDS enacts appropriate contractual and technical protections to limit access, use and disclosure of any information to third parties.

In certain circumstances BDS may disclose information if it is necessary to comply with federal or local laws, regulations or legal requests; to protect the safety, rights, or property of the public or of an individual; or to detect, prevent, or otherwise address fraud, security or technical issues.

  1. DATA RETENTION.  BDS will retain your personal information that you provided as long as needed to render services to you, or as described in the Terms of Use.  BDS will retain and use your personal information as necessary to comply with legal obligations, resolve disputes, and enforce agreements.

OTHER WEBSITES.  The Subscriber may be able to access other websites through the Service.  When the Subscriber does so, they are thereby subject to those other sites policies regarding privacy and data collection and the Subscriber should read those sites privacy policies to ensure that they agree to them before using such sites.
  1. CHANGES TO PRIVACY POLICY.  This Policy may change from time to time.  BDS reserves the right, at its discretion, to modify this at any time by posting a notice on the Service, sending a notice via e-mail, or by adding such changes to the Service.  The Subscriber will be responsible for reviewing and becoming familiar with any such modifications.  Use of the Service following such notification constitutes Subscriber's acceptance of the Policy as modified.  Unless stated otherwise, the current Policy applies to all information that BDS has regarding the Subscriber and their Service account.
